Year end net income was $450,738.59 which is $296,641 above what was budget for 2025. The extremely dry year resulted in high water sales which is great but it also made it hard to keep the lake full and all the tanks topped off. Operating expenses for the year were right on track even though we fixed a few leaks and replaced broken meters during an early winter cold snap. The new PLC and filter#2 refurbishment will all be plant upgrades and capitalized which the accountant is working on to be ready for the March audit.
Water production for December was 6,749,549 of that 5,693,549 gallons were distributed and 4,051,954 were sold. The lake Currently is at 789 acre feet which we will see it drop 8 to 10 acre feet per month.
Rate Relief Request:
45 Mayday lane is asking for rate relief since the neighbor watching their house left the shower running while doing a weekly walk through. Mr. Kaim has been a customer since 2005 and has neighbors check on his house while they living out of state. This was an unfortunate accident that was resolved quickly once staff notified the customer of unusual usage. Board voted unanimous no because the shower was left on for over a week and this was not a leak.
Source and Supply:
So far the winter has produced very little precipitation which means we are going to lean heavy on Nighthorse pumping since the ditch may not produce. This means we will have to take advantage of pass through pumping in May and then alternate weeks in June to refill the lake. This summer we will need our full Nighthorse allocation but we must fill at different intervals so we do not shock the lake and create an early turnover. If we fill the lake too fast with colder water the lake will turnover causing taste and odor issues. Also refilling at different intervals keeps the lake colder reducing the chances of an algae bloom which is hard on the filters.

Treatment:
This winter has started out very dry and warm which actually lets us distribute water at a higher rate because of the chlorine and contact time in the clearwell. This also allows for more flexibility to adjust flows as we see different demands from some of the bulk customers as we move out of the Holiday season and into slower winter months.
- Approve Rate Resolutions 26-4
The Rate Relief Resolution is to stop customers from receiving rate relief from a leak associated with their irrigation. The authority has faced many rate relief scenarios where customers did not manage their irrigation systems properly resulting in a loss of water and ultimately the customer had their premiums reduced. The main premise of the resolution is to promote conservation and to reduce stress on the distribution system so customers better manage their water use. Board wants to table this until Legal can give a full review and draft.
- Rate Hearing Notice.
The main point of the rate hearing notice is to update the customers on the proposed rates which will take effect on March 1st. The notice will be distributed to all retail and wholesale customers so they have a chance to voice any concerns and better understand the Authorities’ perspective after the Cost of Service study. A sample of the rate hearing notice will be distributed to the board so any adjustments can be made before the notice is distributed to all customers. Board wants to table this until legal can give a full review. Possible rate hearing March 19th. Notices must be sent out in February so both route billing cycles can have enough notice.

The final COS was discussed, and the board wants to review with Raftelis before we close out the study. Staff will ask if Raftelis can give an overview at the rate hearing to help answer some of the analysis explanations.

Gallagher will meet with staff this week to go over the pre renewal for insurance coverage for 2026. The profit and loss statement is attached and we have a glitch in quick books so the financials are just for January not the annual comparison. This will be fixed for Februarys financials.
Water production for January was 8,680,000 of that 6,425,400 gallons were distributed and 3,466,253 were sold. A leak surfaced over in Trappers Crossing and keeping our tanks full accounts for some of the difference between distribution and sales. The lake Currently is at 759 acre feet which puts us at an estimated 719AF before we can start pumping Nighthorse water in May. Logan stated we should have a rate study in 2027 and to set aside money in the budget to stay current with rising costs. Logan talked about a leak detection company that can map out the distribution system and find leaks that have not surfaced.
Rate Relief Request:
45 Mayday lane asked for an appeal on the rate relief not being approved. The board discussed the request and determined the shower being left on was not a leak. Board Unanimously voted no.
52 Rendezvous had a leak in their service line which Chris found and notified the homeowner. The owners jumped on the issue and had the leak excavated a few days later repairing and testing the line. The house was built in 2000 and the address has never asked for rate relief. Mike motioned to approve Tier 1 relief, Logan 2nd, approved.
Source and Supply:
With very little precipitation so far this winter(less than 2002) we will have to enter summer on usage restrictions. After multiple dry years we will not have enough Nighthorse water to top off the lake while feeding normal consumption rates. If we have a wet spring and wet summer we can always lift restrictions but for planning purposes level 1 restrictions will start in April.

Treatment:
The chlorine Dioxide generator is scheduled to show up late February with Training in early March. We are excited to see how much this new piece of equipment will help with taste and odor since it will automatically adjust concentration levels. The older generator is 25 years old and since the merger the new company has doubled their quarterly service rates. We are excited to learn a new piece of equipment that benefits all customers and work with a new vendor.

4. Rate Hearing.
The purpose of the hearing is to inform customers of how the Cost of Service Study was conducted and the implemented transitional rates. Todd will give a presentation on the analysis of the different customer classes and costs associated with retail and wholesale. Todd explained the analysis process of the cost of service study over the last year. Todd explained the process to capture all the different cost allocations broken down between multiple retail zones and wholesale customers. The analysis covered the cost allocations for common to all expenses vs expenses incurred from specific subdivisions or geographic boundaries. Todd explained the unique and complex distribution system so that the visitors could understand where the cost pools were associated with each customer class. Rates were discussed based on each zone compared to prior years of overall 5% increases to all.
6. Financials, Billing, DOLA etc.
Sales are slow right now in the spring but two months in we are only short $3,800 for total water sales, typically things don’t pick up until May. We are gearing up for a busy summer but keeping expenses tight for the next month.
Water production for February was 7,860,000 of 5,893,700 gallons were distributed and 3.4 million were sold (1.2 million in tank storage). The lake Currently is at 752-acre feet so we will have to use our full river allocation and pass through pumping during May when ALPOM&R is filling Nighthorse. We have June and the rest of the summer to pump our storage allocation which may be in different installments to keep temperatures low. We are balancing forecasts of another dry summer which means we must keep lake health, capacity and demand all aligned.
The Dola grant application was submitted in February, and we just had another meeting to edit the application for their internal presentation. If awarded this grant will help refurbish the Lake Durango Tank along with a double tax-exempt loan (should have numbers in May). We should hear back in mid-April on the status of this competitive grant due to overall funding shortages. We are staying competitive according to DOLA because we have all our information and project planning submitted. So far DOLA has been very helpful, but they reiterated this year is highly competitive due to state funding shortages.
Source and Supply:
We will have to start April on stage 1 restrictions so we can fill the lake in May and not get so far behind we can’t catch back up with demand. Stage 1 restricts outside water use twice a week for two hours. (See notice).
Pine Ridge Ditch had their annual meeting and looked at a few projects this summer since we will have little to zero chance of water. The board agreed to take advantage of the dry year and keep fixing some erosion areas where debris can reduce flow.
LDWA, LPWWA and ALPOM&R met to discuss this year’s pumping scenarios and some tighter reporting standards. LDWA will have the ability to help run the Nighthorse pump so we can have more flexibility on pumping and take advantage of our river allocation.

Spoke to our compliance specialist Tim Jones regarding the 2,4-D sampling schedule. The result was below the detection limit, but the average of the sample result and the previous sample is above the detection limit (0.0001 mg/L). The state decided that we will need to sample, at a minimum, for the next 3 quarters.

Treatment:
The chlorine Dioxide generator was delivered and moved into the new building so now we just need IDI to install and plum it into our system. Browns Hill needs to run cable and tie into our PLC and after a few adjustments configuring, we should be ready in April. This will be a great addition to the plant with the generator adjusting to distribution flows. All customers will greatly benefit from this new equipment, and we should see improvements with taste and odor if the lake turns over.
7. Rates Resolution 2026-5:
Approval of the 2026 rates based off the Cost of Service Study and the transitional rates voted on and approved 12-18-2025 following a rate hearing. James Cambell discussed the 2014 agreement and reiterated the Nighthorse infrastructure and partnership with LDWA for a rate committee meeting. A rate committee will be formed to address LPWWA concerns.

Public Comment: Bob Manning (RJHOA) extended his appreciation from the LDWA board on the fire suppression project and Engineering analysis connected to the Rafter J Tank tie in. Multiple questions were answered about drought conditions and usage restrictions that would be enforced this summer. Tast and odor questions were explained about last summers lake turnover and unexpected algae bloom in September. Staff explained lake treatment options along with Nighthorse pumping scenarios to mix and reduce lake temperatures. A few questions were answered about Nighthorse water and that LDWA does not distribute water to the City of Durango.
Todd Cristiano from Raftelis gave a description of the cost of service analysis that started in December of 2024. He explained how the analysis was constructed along with the vast complexities of the distribution system. He also stated that now the authority has a road map to use for the future and to keep refining.

We are currently in the middle of the 2025 Audit with Haynie and Company and it should be going to partner review soon.
Water production for March was 6,826,970 of that 5,936,266 gallons were distributed and 4,033,544 were sold. A leak(valve) was discovered on Conestoga way which will be repaired next week. The lake Currently is at 728 acre feet which still puts us at stage 1 restrictions. Mike requested zoom be set up for future meetings.
Rate Relief Request:
Multiple rate relief requests caused by failed irrigation systems have been denied. The new resolution 26-5 is already saving the authority time and money during this drought year.
Source and Supply:
Browns Hill spent a few days working on the sensors and PLC at the Nighthorse booster station. There were some pressure issues that have been resolved so we can start pumping next week and run all May. We will fill the 25 acre feet that LPWWA used last year and take advantage of our river allocation during May. The plan is to use most of our storage allocation but leave 50 acre feet for mixing the lake during the summer to keep the water temperatures low. This will be a balancing act if we have another hot dry summer. If conditions are beyond staffs control we will have to plead our case with ALPOM&R and ask for JOINT POOL water because of drought conditions. This is why we have not asked for joint pool water every year in hopes that we could ask during this type of scenario. The ALPOM&R board could also say we grant your request this year but you need to buy more water and avoid these situations. Staff gave an explanation of some troubleshooting needed at the booster pump to figure out irregular pressures. Pumping protocols were explained on how to operate the pump manually.
Matt explained some projects on the pine ridge ditch to fix some old worn out parshall flumes and waste gates.

Treatment:
During pumping in May we will treat the lake with copper sulphate to kill off any chance of algae growth during the warm summer. If we have consistent high temperatures with no precipitation, we will have to treat the lake again or risk an algae bloom. If we do not have any precipitation for 3 months we will need to start pumping Nighthorse water again to keep lake temperatures low. By mixing water late summer we hope to keep the water temperatures at a consistent level so we can try and avoid the lake turning over.
- Lake Durango Tank Update:
Currently SEH is working on the water modeling to figure out how to integrate the auxiliary tanks to supply enough water and pressurize the distribution system. Time is of the essence now on SEH to figure all this out before we can sign a contract for work done in 2026. If timing does not work out we will have all the information to start this project next spring or fall. We still do not know if the Dola grant will be awarded and we have a bank on standby to give us a line of credit or set 20 a year loan that the board will have to approve. This project is very complex with a lot of moving parts which is why we started the process to figure out all the time-consuming pieces.

Sales are slightly under for the month given the restrictions and time of year but four months in we are close to budget. We have kept expenses tight except for a few leak repairs and chemical orders. Water production for April was 6,019,259 of that 5,325,259 gallons were distributed and 3,892,178 were sold.
Liability Insurance was renewed after much discussion and only increased $600 which is a huge win after hearing about other authorities. The lake Currently is at 723 acre feet which still puts us at stage 1 restrictions.
Rate Relief Request:
Nobody qualified for rate relief this month.
Source and Supply:
After fixing the booster pump station (pressure Transducers) we are pumping 3.5 acre feet per day which is better than last year where we could only get 3.2 AF per day. Its not a huge difference but when you multiply that over a few months it can add up to 18 extra acre feet. This also helps when you are trying to pump every drop from our river allocation during May when pass through pumping is allowed while Nighthorse is filling.

In January, Treatment technologies out of Denver came to the plant to jar test some of their coagulants. I got in touch with the state to inquire about the “coagulant demonstration” process for future supplier options.
Normal day to day operations
Treatment:
The last week in May we will treat the lake so we are mixing the new water pumped from Nighthorse which helps distribute the copper sulphate. If we have multiple months of high temperatures and little precipitation we will need to treat the lake again to prevent algae blooms. So far the new PLC and new batch generator have been operating together properly as we fluctuate flows which is a huge upgrade.
6. Lake Durango Tank Update:
Currently SEH is finalizing the auxiliary tank plan with multiple storage tanks along with a pneumatic tank and pump for supplying pressure. We should have the plan in place by the time of Thursdays meeting since May is the deadline for the August start date. We were awarded $175,000 from DOLA so we will need the bank to cover the rest with a line of credit or 20 year loan. This project has many moving pieces, which is why we started last December but we are inching closer to contracts. Mike made a motion in principle to approve the refurbishment plan/contract but to get additional loan options to cover the remainder of the project cost, Beverly 2nd, approved.
7.Audit Update.
The 2025 Audit is complete and ready for your review. The entire process went really smooth this year after explaining the extra water sales from drought and increase in payroll expenses (overtime and vacation payouts). A discussion was had on the audit process, and the board was happy that it went very smooth. Matt stated that Haynie was great to work with and having the ability to start in March was very beneficial for staff.

Visitors: Steve Krest( LPWWA). Steve asked that LPWWA and LDWA meet to discuss rates and the operational agreement. The board asked Steve why LPWWA asked for a meeting in April and then never set a date, now they want to meet to discuss rates?? Matt asked why LPWWA was not setting any restrictions on customers or construction companies using the fill station hauling 40,000 gallons a day. Matt asked why would you would not charge commercial haulers more at the fill station since they are pushing your system and ours to max compacity. Steve said I don’t know, we need to figure that out when the president comes back from vacation. Steve stated LPWWA values the working relationship and extra help from LDWA especially when their tank dropped to 6 feet during a valve replacement on the tank.

Sales are on point for the month even though we are under $39,000 5 months in due to restrictions. Water distribution for May was 7,497,933 of that 5,986,104 gallons a were sold.
The lake Currently is at 773acre feet which still puts us at stage 1 restrictions. We may have to add volumetric restrictions in the future to stop wasteful consumption. A discussion was had that instead of alternating days limiting outside watering a volume limit may be needed in the future. As the retail system grows customers who try and irrigate will have to pay steep tiered prices during restrictions.

ALPOM&R turned off their pumps on June 3rd so during May we were able to get our river water allocation of 106AF. We kept the Nighthorse booster pump on so all June we will be using our storage allocation. Daily we are pumping 3.5 AF but only 2.1 AF is retained in the lake since we are seeing consumption rates 1 month ahead of schedule.

Since treating the lake and adding Nighthorse water we have kept the algae blooms away. We did receive more copper sulphate so if we need to treat the lake again, we are ready. The temperatures, precipitation and clouds all play a part in how the lake reacts, so we are trying stay ahead of each scenario. We have to be ready for high temperatures or the opposite with monsoons flooding the lake with nutrients like last September.
6. Lake Durango Tank Update:
SEH sent us the updated contract with their Sub listed as Classic Coatings. This is the only company that works with SEH and their tank maintenance division(Bud is reviewing). The five year variable plan identifies the costs associated with each year of the five-year maintenance program, for an aggregate of $893,000 for the five years. The annual inspections align with CDPHE, the maintenance in year 5 is prescribed by SEH to have the coating system last longer. All the while the inspections allow you first refusal to perpetuate the warranty for the long term, including the first five years.
Bud is working with Bank of the San Juans and Alpine to see what requirements they may have with parity agreements, bond counsel and rates . Wells Fargo stated the loan was too small for all the different hoops to jump through regarding legal fees. More to come… Beverly stated that once Bud worked through the contract and some of the edits were made we should proceed.

Approval of the Agenda. Unanimous.
Public Comment or Questions. Sharron spoke about working together and attending more meetings so both sides could keep ironing out growing pains. Staff explained that commercial haulers were hurting their system and if their tank levels cant keep up, they need to restrict the fill station and cut back on commercial haulers. Staff explained the tank project and required restrictions along with a project scope for the refurbishment. LDWA board asked why LPWWA has not enacted restrictions and or changed rates? Sharron said that they were working on it and that’s its been a busy summer with all the operational challenges.

5. Financials, Billing, Audit, etc.
Sales are on point for the month even though we have restrictions and slightly under six months in. We have most of the system following restrictions and the high users are making up for it with the higher tier rates. Water distribution for June was 8,944,155 gallons of that 6,623,174 gallons were sold.
The lake Currently is at 813 acre feet but we are still on restrictions, so we don’t lose all the water we pumped for months.
Rate Relief Request:
1680 Ridge Road had a water leak in their crawl space that originated from their pressure tank. Once they noticed the leak, they called the plumber and the Authority to notify us so we could shut them off immediately. Staff spoke with the plumber/resident on site and the repair was finished the evening of June 12th.
Source and Supply:
Nighthorse pumps are still on and we finished our pass-through pumping for the year reaching 101AF. We will pump our full storage allocation of 224AF by August 1st. So far this summer we have retained %70 of the water we pumped so we need to be careful we are at manageable level for next year if we do not have any snow. To help manage supply for the future we need to examine higher tiered rates so we can manage wasteful consumption.

Treatment:
We treated the lake a third time because high temperatures and warmer water pumped from Nighthorse are a perfect recipe for algae blooms. Hopefully the monsoon season produces some much-needed moisture and the clouds help cool off lake temperatures.
6. Lake Durango Tank Update/Bank Resolution 26-5:
SEH is gearing up and organizing the crews for a start time in early August. The plan is to refurbish the tank and have it all functional early October because we could see colder temperatures and possibly snow a earlier this year. This means site preparations and auxiliary tanks need to be installed and tested for a week before we take the main tank offline in the next 2 weeks.
Bud has been organizing and coordinating with Alpine bank to secure financing for the tank project. The parity agreement and certificate have been executed, moving us to the next step of bond counsel plus 13 more documents to sign off. Resolution 26-5 will need to be signed once the entire loan is approved after bond council so we may need a special meeting.
